We originally began in 2011 as we saw Smart Meter technology being implemented by EWEB. (Eugene Water & Electric Board) There was a long history of us speaking at EWEB and Eugene City Council meetings making people aware of the dangers of Wireless technology. EWEB had agreed not to force Smart Meters upon us, that is we could keep our analog meters, which emitted no EMF (Electro Motive Force) radiation. This is the same frequencies as emitted by your Microwave Oven or Cell Phone in the range of 2 – 3 Gigaherz. In February of 2018 EWEB announced that every one will have Smart Meters by the end of 2021. This was often done when people were away at work and not in their home. April 22, 2019 Eugene City Council meeting The FCC’s 1996 Telecommunications Act is a federal regulatory program to be implemented only in federal territory. The U.S. Supreme Court’s anti-commandeering doctrine prohibits any federal agency, including the FCC, from making an officer of any state or city comply with any of their regulatory programs, as long as they are outside of federal territorial jurisdiction.
If you continue to use FCC regulations as a reason to allow potentially harmful 5G, you will be violating the fundamental rights of health, safety, security and privacy of the people you claim to serve, and by doing so will have broken the law by acting beyond your power. This is known as the ultra vires doctrine. *ULTRA VIRES – Wikipedia Ultra vires is a Latin phrase for “beyond the powers”. The ultra vires doctrine typically applies to a… government department or a local council so that any act done by the body which is beyond its capacity to act will be considered void. ultra vires applies if there is an abuse of power (e.g., unreasonableness or bad faith) or a failure to exercise an administrative discretion (e.g., acting at the behest of another or unlawfully applying a government policy).
